These Terms of Service (“Terms”) govern your use of the AI Plant Identifier mobile application (the “App”), operated by Elite Autolocks Repairing LLC (“we,” “our,” or “us”).
By downloading, accessing, or using AI Plant Identifier, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.
1. Use of the App
AI Plant Identifier provides plant identification and related informational features, which may include identifying plants from images and providing information regarding plants, diseases, conditions, care, and prevention.
You agree to use the App only for lawful purposes and in accordance with these Terms.
You must not:
Use the App for any unlawful, fraudulent, or unauthorized purpose.
Attempt to interfere with, disrupt, or compromise the App or its related services.
Reverse engineer, decompile, disassemble, or otherwise attempt to obtain the source code of the App, except where such activity is expressly permitted by applicable law.
Attempt to gain unauthorized access to our systems, servers, or services.
Use automated methods to access or interact with the App in a manner that could damage or interfere with its operation.
Use the App to transmit malicious software, harmful code, or other disruptive material.
Misuse or abuse any identification or AI-powered functionality.
2. Plant Identification and AI-Generated Information
AI Plant Identifier uses technology designed to identify plants and provide related information based on images or other inputs provided by users.
The results provided by the App are for informational and educational purposes only.
Plant identification and AI-generated information may not always be accurate, complete, or up to date. The App may incorrectly identify a plant, disease, pest, condition, or recommended treatment.
You should independently verify important information before relying on it, particularly where incorrect identification or advice could result in harm to people, animals, plants, property, or the environment.
The App should not be relied upon as a substitute for professional advice, including advice from qualified botanists, horticulturalists, agricultural professionals, veterinarians, physicians, or other appropriate professionals.
We do not guarantee that any identification, diagnosis, recommendation, treatment suggestion, or other information provided by the App is accurate or suitable for a particular situation.
3. Images and User Content
The App may allow you to submit photographs or other content for plant identification and related functionality.
You are responsible for the content you submit through the App.
You represent that you have the necessary rights and permissions to submit any images or other content that you provide.
You should not submit photographs containing sensitive personal information, government documents, financial information, passwords, faces, or other information that you do not want processed.
Images may be transmitted to our servers or third-party services when necessary to provide the requested functionality.
Our handling of information is described in our Privacy Policy.
4. Intellectual Property
The App, including its software, design, user interface, graphics, text, trademarks, logos, features, and other content, is owned by or licensed to Elite Autolocks Repairing LLC and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, publish, sell, license, or create derivative works from any portion of the App without our prior written permission.
The AI Plant Identifier name, branding, logos, and related materials may not be used without our permission.
5. Third-Party Services
The App may use third-party services and technologies to provide, operate, analyze, or improve certain features.
These services may include analytics, cloud services, AI or image-processing services, hosting services, and other technology providers.
Third-party services may have their own terms and privacy policies. Your use of third-party services may be subject to those terms in addition to these Terms.
We are not responsible for the availability, accuracy, security, or performance of third-party services that are outside our control.
6. Availability and Changes to the App
We may modify, update, suspend, or discontinue any part of the App at any time, with or without notice.
We do not guarantee that the App or any particular feature will always be available, uninterrupted, error-free, or compatible with every device or operating system.
We may release updates, bug fixes, security updates, or other modifications that may be necessary for the continued operation of the App.
7. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.
We do not warrant that:
The App will always be available or uninterrupted.
The App will be free from errors, bugs, or security vulnerabilities.
Plant identification results will always be accurate.
Information provided by the App will be complete, current, or reliable.
The App will meet your particular requirements.
Any information or recommendations provided by the App will produce a particular result.
You use the App at your own discretion and risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Elite Autolocks Repairing LLC and its owners, employees, contractors, affiliates, service providers, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of, or inability to use, the App.
This includes, without limitation, damages resulting from reliance on plant identification results, disease identification, treatment recommendations, plant-care information, inaccurate information, loss of data, service interruptions, or third-party services.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
9. User Responsibility
You are responsible for determining whether information provided by the App is appropriate for your particular circumstances.
You acknowledge that plant identification and disease identification are subject to limitations and that AI-generated results may contain errors.
For potentially harmful, poisonous, invasive, or otherwise hazardous plants, you should obtain confirmation from an appropriate qualified professional before consuming, handling, treating, removing, or otherwise interacting with the plant.
10. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Elite Autolocks Repairing LLC, its affiliates, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising out of or related to:
Your use or misuse of the App.
Your violation of these Terms.
Your violation of applicable laws or regulations.
Content or images that you submit through the App.
Your infringement of another person’s rights.
11. Termination
We may suspend or terminate your access to the App if we reasonably believe that you have violated these Terms, misused the App, or engaged in conduct that could harm the App, its users, or our services.
You may stop using the App at any time by deleting it from your device.
Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will continue to apply after termination.
12. Privacy
Your use of the App is also subject to our Privacy Policy, which explains how information is handled in connection with the App.
Our Privacy Policy is incorporated into these Terms by reference.
13. Children’s Use
AI Plant Identifier is not intended to knowingly collect personal information from children.
If you are a parent or guardian and believe that a child has provided personal information through the App, please contact us using the contact information below.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of the United Arab Emirates, without regard to conflict-of-law principles.
Any disputes arising from or relating to these Terms or the App shall be subject to the jurisdiction of the appropriate courts, subject to any mandatory rights or protections provided by applicable law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App, our services, or applicable legal requirements.
When we make changes, we will update the “Last Updated” date at the top of these Terms.
Your continued use of the App after changes to these Terms become effective constitutes your acceptance of the updated Terms.
16. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and Elite Autolocks Repairing LLC concerning your use of the App.
